Jersey Housing Law in Plain English


Detailed below is a summary of the Jersey housing law.

Regulations 1...

Regulation 1 (1)(a)
Applies to people who were born in Jersey and have completed any period of 10 years’ residence in the Island.
 


Regulation 1 (1)(b)

Applies to people who owned or leased accommodation prior to 1949.



Regulation 1 (1)(c)
Applies to people who own or lease accommodation acquired from the crown and therefore exempt from the Housing Law.


 
Regulation 1 (1)(d)

 

 

Applies to people who were given consent from the committee to buy property, have done so within a six month period and are now living there. Generally applies to non-qualified spouses who bought property jointly with their qualified spouse before October 11 1995.
 


Regulation 1 (1)(e)

Applies to people who have rented property with the consent of the committee for a continuous period of 10 years.
 


Regulation 1 (1)(f)

Applies to people who have lived in the Island for 18 continuous years.
 


Regulation 1 (1)(g)

Applies to people who would experience hardship, other than financial, were consent not granted.
 


Regulation 1 (1)(h)

Applies to people not born in Jersey, but who have a residentially qualified parent, moved to the Island prior to their 20th birthday and have lived here for a 10 year period.
 


Regulation 1 (1)(j)

Applies to people who the committee recognise as ’essentially employed’ that is justified as being in the best interests of the community.
 


Regulation 1 (1)(l)
Applies to an association incorporated by the states and approved by the Queen in council or a trust created on application to the Royal Court, the purpose of which must be related to either sport, the arts, religion, education, charity or public utility.
 


Regulation 1 (1)(m)

Applies to a ’recognised religious body’ seeking to buy or lease a property.



Regulation 1 (1)(n)
Applies to non-qualified spouses able to join in the purchase or contract lease of a property with their qualified spouse.
 


Regulation 1 (1)(n)(iii)
Applies to non-qualified spouses who have lived together with their qualifies spouses
For a 10 year period.
 

Regulation 1A
Applies only to renting property. All persons qualifying to purchase property can qualify to rent except those qualifying under regulations 1(1)(n) and 1(1)(n).


 
Regulation 2
Applies to a company whose request to buy property is not viewed as detrimental to the interests of the community.
 

 
Regulation 2A
Allows people qualified under regulations 1(1)(b), 1(1)(c), 1(1)(d), 1(1)(e), 1(1)(f) and certain categories of 1(1)(h) to leave Jersey for a single period of up to 5 years and still retain their qualifications


 
Regulation 5
Applies to people who can rent accommodation without prior consent of the committee, namely persons qualified by regulations 1(1)(a), 1(1)(h) if they have previously occupied a property with the consent of the committee and persons who have entered into a lease with an individual who is ordinarily a resident in the island to rent a furnished dwelling to be his principle place if residence in a single occasion for no more than a period of 3 months.
